Agreement for using octa AI
1. Acceptance of Terms
By downloading, installing, or using the octa AI iOS application ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.
2. Service Description
octa AI is an iOS application designed to assist users with learning through AI-powered tools including study organization, flashcards, quizzes, note-taking, translation, and tutoring features.
3. "As Is" Provision
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or reliability of results
- Uninterrupted or error-free service
4. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any damages arising from:
- Use or inability to use the App
- Errors, mistakes, or inaccuracies in AI-generated content
- Any interruption or cessation of service
- Loss of data or content
- Any third-party content or conduct on the App
You acknowledge that AI-generated content may contain errors and should not be relied upon for critical decisions without verification.
5. User Responsibilities
You agree to:
- Use the App in compliance with all applicable laws and regulations
- Not use the App for any unlawful or prohibited purposes
- Not attempt to circumvent any limitations or security features
- Verify AI-generated content before relying on it for important decisions
- Maintain the confidentiality of your account credentials
6. Intellectual Property
All intellectual property rights in the App and its original content remain with octa AI. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
7. Third-Party Services
The App integrates with third-party services for AI capabilities. These services are subject to their own terms and conditions. We are not responsible for the performance or availability of third-party services.
8. Subscription and Payments
Some features may require a subscription. All payments are processed through the Apple App Store and are subject to Apple's terms and conditions. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
9. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms.
10. Changes to Terms
We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms. We will notify users of material changes through the App or via email.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which octa AI operates, without regard to its conflict of law provisions.
